Head-to-head
Coinbase vs Binance (2026): Where Each Is Legal, Fees and Safety
If you live in the US or the EU, the Binance vs Coinbase question is settled by availability before fees come into it: Binance.com is closed to US residents, who must use the separate Binance.US, and Binance does not appear on the EU's register of MiCA-authorised providers, while Coinbase is licensed in both places. For most readers of this site, Coinbase is the one you can lawfully use. Binance is a genuine option only in markets where it holds a licence, such as Dubai. Even there, weigh its 2023 US settlements before trusting it with savings.
We name Binance for comparison only and place no sign-up link on it, because it cannot be promoted lawfully to most of our readers. Coinbase links on this page are affiliate links. Facts below were read from regulators and the companies' own pages on 9 October 2026.
The availability wall comes first
Availability decides this comparison for most people, so start there. The question is not which exchange is better in the abstract; it is which one your regulator allows to serve you.
United States. US residents cannot open Binance.com accounts. Americans who want the Binance brand use Binance.US, run by a separate company, BAM Trading, which does not serve 12 states. Binance.US does not appear on New York's list of licensed virtual-currency firms, and New York is one of the states it excludes. Coinbase holds a New York BitLicense dating from January 2017.
European Union. Under MiCA, crypto firms serving EU customers need authorisation. ESMA's interim register, read on 9 October 2026, lists Coinbase Luxembourg as authorised since 20 June 2025. It lists no Binance entity. ESMA notes the interim register is moving to a new system, so absence is not proof of a ban, but it is not the green light an EU reader needs either.
United Kingdom. UK crypto promotions have been regulated since 8 October 2023, and promoting crypto to UK consumers without the right permission is a criminal offence. We could not read the FCA register for this update, so check any exchange there yourself before you sign up. The FCA's own guidance says crypto is largely unregulated in the UK and unlikely to be covered by the Financial Services Compensation Scheme.
Elsewhere. The map is not one-sided. Dubai's VARA licensed Binance FZE on 15 April 2024; Coinbase does not appear on VARA's register. In Singapore, the MAS directory lists Coinbase Singapore as a licensed digital-payment-token provider and does not list Binance.
Fees compared, dated
Where both are usable, Binance's order book is cheaper on paper. Binance.US's fee page, read on 9 October 2026, shows 0% maker on all spot pairs and 0.02% taker on most, with a 5% discount for paying fees in its BNB token. Funding by ACH is free, a wire in is free and a wire out costs $25. Card purchases cost 3.99%. Its Convert feature charges no explicit fee but builds a spread into the rate.
Coinbase charges more, and how much depends on the screen. Its pricing disclosure says simple buys include a spread plus a Coinbase fee that varies with payment method, size and location. Simple limit orders add a 1% execution fee. Coinbase Advanced has no spread; you pay a maker or taker fee by tier, and Coinbase advertises maker fees as low as 0.0% at its top tiers. Its entry-tier table is only visible after signing in, so we cannot print it here.
| Cost | Coinbase | Binance.US |
|---|---|---|
| Order-book trade | Advanced: tiered maker/taker, no spread | 0% maker / 0.02% taker (most pairs) |
| Simple / instant buy | Spread + Coinbase fee, shown at preview | Convert: no fee, spread in the rate |
| Simple limit order | 1% execution fee, plus a possible 1.875% Coinbase fee (varies by payment method) | n/a |
| Card purchase | Shown at preview | 3.99% |
| Bank deposit | Fee depends on method; shown before you confirm | ACH free; wire in $0 |
| Bank withdrawal | Fee depends on method | ACH free; wire out $25 |
| Crypto withdrawal | Network fee estimate, shown first | Dynamic, shown before confirming |
For a US buyer, the honest summary is that Binance.US's order book costs less, Coinbase's simple screen costs most, and Coinbase Advanced sits in between. Paying 3.99% by card on Binance.US wipes out the advantage on small purchases. Fees are one input, though, and on this matchup they are the smaller one.
Regulation and enforcement history
Both companies faced SEC lawsuits, and both cases are now closed, but the two records are not the same. The SEC filed 13 charges against Binance, BAM Trading and founder Changpeng Zhao on 5 June 2023. Separately, on 21 November 2023 the US Treasury announced its largest-ever settlements with Binance: a $3.4 billion FinCEN civil penalty and a $968 million OFAC penalty, with a five-year monitor, as part of a wider resolution with the Justice Department and the CFTC. In all, Binance paid more than $4 billion across those Treasury settlements alone.
In 2025 the SEC changed course on crypto. It dismissed its civil case against Coinbase on 27 February 2025, and on 29 May 2025 it and the defendants filed to dismiss the Binance case with prejudice. The SEC said it acted as a policy matter, which is not a finding either way on the original allegations. The Treasury settlements and monitorship are separate and were not undone by that dismissal.
Broader US rules are still unsettled. The CLARITY Act, which would set out market-structure rules for crypto, passed the House in July 2025 but stalled in the Senate after a 49–50 procedural vote on 15 September 2026. It is not law.
Safety and proof of reserves
Neither exchange is a bank, and neither is government-insured for crypto. In its 2025 annual report, Coinbase describes a one-to-one backing of customer assets and a target of 2% or less in online hot wallets; US dollar balances sit with FDIC-insured banks or money market funds, but no government agency insures the crypto itself. The same filing admits no court has yet tested its custody terms in a bankruptcy, so customers might rank as ordinary unsecured creditors if the company failed. That risk applies to any custodial exchange, Binance included.
Coinbase's worst recent incident was not a hack of its wallets. In May 2025 it disclosed that bribed overseas support contractors had stolen customer data, which criminals used for impersonation scams; passwords, keys and funds were not accessed. Its annual report says it paid $311.2 million in cash in 2025 on the incident, mostly reimbursing customers who were tricked.
Several exchanges publish proof-of-reserves snapshots. Treat those carefully. A snapshot can show that an exchange held certain assets at a moment; it does not prove what it owed at that moment, or replace an audit. The stronger protection is the one you control: keep only trading balances on any exchange and move savings to a wallet you hold yourself.
Binance.US vs Binance.com: not the same thing
Many "Binance vs Coinbase" articles compare Coinbase with the global Binance.com, which no American can use. For a US reader the real comparison is Coinbase vs Binance.US, a separately run US company with its own fee schedule. Binance.US describes itself as a licensed and regulated US exchange. Its support page, dated 3 June 2026, lists 12 states it does not serve: Alaska, Connecticut, Georgia, Maine, New York, North Carolina, North Dakota, Ohio, Oregon, Texas, Vermont and Washington, plus several US territories. In Kansas and Wisconsin it offers crypto only, without US dollar deposits.
Binance.US's headline fees are low, as the table shows. The practical gaps are elsewhere: residents of a dozen states, including New York and Texas, are excluded, and the card fee is high. If low order-book fees are your only priority and you can use it, it is a defensible choice, though we do not link to it. If you also want a broad set of licences, audited public-company filings and a regulated EU entity, Coinbase is the fit.
Coinbase vs Binance by country
- US, most states: Coinbase or Binance.US are both lawful, unless you live in one of the 12 states Binance.US does not serve. Binance.US is cheaper on its order book; Coinbase has the stronger licensing record and public filings.
- New York: Coinbase. Binance.US is not on the NYDFS licence list.
- EU: Coinbase. Binance is not on ESMA's MiCA register as of 9 October 2026.
- UK: Check the FCA register for each firm before you sign up.
- Dubai: Binance FZE holds a VARA licence; Coinbase is not on that register. Compare the licences you can verify, and the 2023 US settlements.
On Coinbase, use the Advanced screen to keep costs reasonable, and do not leave long-term holdings on the exchange. For a low-fee alternative that is MiCA-authorised in the EU and serves most US states (not New York or Maine), compare Binance vs Kraken and Coinbase vs Kraken.

Edge cases before you decide
- You travel or move. Exchange access follows your residence, not your passport. Reaching a platform that does not serve your country through a VPN can breach its terms and leave funds stuck in a frozen account.
- Someone offers to open a Binance account for you. Do not. Accounts in another person's name are a common route into fraud and lost funds.
- You want BNB fee discounts. Paying fees in an exchange's own token adds that token's price risk to your costs.
- You see "zero fees". On Binance.US that means maker orders on the order book. Convert still has a spread, and cards cost 3.99%.
- You are in the UK. Under UK rules, a first-time investor must wait 24 hours before receiving a direct offer from a crypto firm. A platform that skips this step is a warning sign.
Crypto is highly volatile, and the whole of any amount you invest can be lost. This comparison is information, not financial, legal or investment advice.
